We are not an IBM Business Partner, reseller, distributor, system integrator, or other commercial affiliate of IBM Corporation. We do not earn commission, fee share, rebate, marketing development funds, or any other consideration from IBM at any time. Our only revenue source is fees paid by our enterprise clients.

Research papers describe our perspective at the time of publication. IBM products, programs, terms, and metrics change over time. Read each paper with the publication date in mind and validate any specific licensing decision against the most recent IBM Passport Advantage agreement and product license information that applies to your environment.
Use of the website does not by itself create a consulting engagement, attorney client relationship, or other professional advisory relationship between you and IBM Licensing Experts. An engagement is formed only when a separate, signed statement of work is executed by both parties. The statement of work governs scope, deliverables, fees, payment terms, confidentiality, and the legal arrangements that apply to that specific engagement.
Where these terms of service and a signed statement of work address the same subject, the signed statement of work prevails for the engagement it describes.
We do not charge for access to the website, the blog, or the white paper library. Fees apply only to consulting engagements. Engagement fees are described in the statement of work and may be structured as a fixed fee, a phased fee, a time and materials arrangement, or a success based component tied to defined and measurable outcomes. We do not accept contingency arrangements that would compromise objectivity.
Invoices are payable in the currency stated in the statement of work, typically within 30 days of invoice date. Late payment may suspend ongoing work until balances are current.
We treat all client information received in the course of an engagement as confidential. Confidentiality terms in a signed statement of work or in a separate mutual non disclosure agreement apply to such information. Without a signed engagement document, information you submit through forms on the site is governed by the privacy policy.
The website and its content are provided on an as is and as available basis. We disclaim, to the maximum extent permitted by law, all warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components.
